The accused persons Christophere Okpe and Chwukwu Okorie were arraigned before the Chief Magistrates Court, Afikpo, Abia State, on 14th day of August, 1991 for the murder of one Aja Obi. The presiding Chief magistrate remanded the accused persons in prison custody and ordered the case file to be transmitted to the Office of the Director of Public Prosecutions for preparation of proofs of evidence. The accused persons by a motion on notice dated 16th September, 1991 made an application for bail pending their trial. The application was brought before Anyanwu J sitting at the Afikpo judicial division of Abia State High court. Their application was granted by Ayanwu. J. and the accused persons were released on bail.
The criminal trial commenced before Achilihu. J. at the Afipo High Court on 14th September, 1992 and the accused persons took their plea and pleaded not guilty. The oral application made to the court by their counsel for their bail to continue was adjourned by the court to 26th September, 1992 for full argument.
The appellants were dissatisfied with the ruling refusing them bail and granting accelerated hearing of the case. They have therefore appealed to the Court of Appeal.
